Terms & Conditions for Money Wise

  1. Acceptance of Terms

By downloading or using the Money Wise app (“the App”), you agree to these Terms and Conditions automatically. Please read them carefully before using the App. If you do not agree with any part of these Terms, you must not use the App.

  1. Use of the App

You agree to use the App in accordance with these Terms and applicable laws. You are not allowed to:

  • Copy, modify, distribute, or reverse engineer any part of the App.
  • Attempt to extract the source code, translate the App into other languages, or create derivative versions.
  • Use any of Money Wise’s trademarks or intellectual property without prior written consent.

All intellectual property rights, including trademarks, copyrights, and database rights, belong to the app developer and are protected under applicable laws.

  1. Changes to the App

The developer reserves the right to:

  • Make changes, updates, or modifications to the App at any time.
  • Introduce new features or functionalities.
  • Charge for certain services within the App, with clear communication of any applicable fees before they are incurred.
  1. Personal Data and Security

The App stores and processes personal data you provide to deliver services. You are responsible for:

  • Keeping your device and access to the App secure.
  • Avoiding actions like jailbreaking or rooting your device, which may compromise security and affect the App’s performance.

  1. Third-Party Services

The App integrates with third-party services that have their own Terms and Conditions. By using the App, you also agree to the terms of these services:

  • Google Play Services
  • Apple Services
  • AdMob
  • Google Analytics for Firebase

We are not responsible for the practices of these third parties.

  1. Limitation of Liability

To the fullest extent permitted by law, the developer is not responsible for:

  • App malfunctions due to lack of internet connectivity or limited data access.
  • Data charges, roaming fees, or other costs incurred when using the App without Wi-Fi.
  • Issues arising from your device running out of battery or being otherwise inoperable.
  • Losses (direct or indirect) resulting from reliance on third-party information provided through the App.
  • Any bugs, errors, or technical issues within the App, including those that may cause data loss, financial loss, or harm to you or your device.

The App is provided “as is” without any warranties, express or implied.

  1. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. The developer disclaims all warranties, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not warrant that the App will be uninterrupted, error-free, or free from harmful components.

  1. Limitation of Liability Cap

To the fullest extent permitted by applicable law, the developer’s total liability to you for all claims arising out of or related to the use of the App will not exceed the amount you have paid, if any, for using the App within the last twelve (12) months preceding the claim.

  1. Indemnification

You agree to indemnify, defend, and hold harmless the developer and their representatives from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your infringement of any rights of another party
  1. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials and personal information
  • Ensuring that all information you provide is accurate, current, and complete
  • Using the App in compliance with all applicable laws and regulations
  1. App Updates and Termination
  • The App may be updated periodically to improve performance, security, or compatibility.
  • You agree to install updates as they become available.
  • The developer may discontinue the App or terminate your access at any time without prior notice.

Upon termination:

  • Your rights to use the App will end immediately.
  • You must stop using the App and delete it from your device.

We may update these Terms and Conditions periodically. You are encouraged to review them regularly. We will notify you of significant changes by posting the updated Terms within the App.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.
